Regulations on Radio Station License Administration
Article 1 In order to strengthen the management of radio stations (stations) and protect the normal work of legal radio stations (stations), these regulations are formulated in accordance with the "Regulations on Radio Management of the People's Republic of China".
Article 2 The radio station license is the legal certificate for legally setting up and using the radio station (station). Various types of radio stations (stations), including standard radio stations installed and used on locomotives, ships and aircraft, must have a radio license before they can be put into use. However, the Ministry of Information Industry stipulates that it is not necessary to obtain a radio license.
A radio station (station) refers to one or more transmitters, receivers, or a combination of transceiver and receiver (including ancillary equipment) necessary for the development of radio services.
Article 3 The radio station license is divided into three types: "The People's Republic of China Radio Station License", "The People's Republic of China Ship Radio License" and "The People's Republic of China Aircraft Radio License", which are printed by the Ministry of Information Industry.
Article 4 The radio station license shall be issued by the Ministry of Information Industry and the radio management agencies of provinces, autonomous regions and municipalities directly under the jurisdiction of the Radio and Television Administration of the People's Republic of China and the relevant management regulations of various radio stations; or by the Ministry of Information Industry Entrusted by the relevant State Council department for approval.
Article 5 The validity period of the radio station license shall not exceed three years, and the temporary radio station (station) license shall not exceed six months.
Article 6 Units and individuals who set up and use radio stations (stations) must submit written applications and necessary technical information to the national or local radio regulatory agencies, and after review and approval, and pay the frequency occupation fee and registration fee in accordance with relevant national regulations After that, the radio station license can be obtained.
Article 7 The license of the radio station must be properly kept. If you lose your radio license, you must trace the whereabouts and immediately report to the original issuing agency.
Article 8 The content approved in the radio station license shall not be changed on its own. If changes are required, an application should be submitted to the original approval authority in advance, and after review and approval, the nuclear power station license should be renewed.
Article 9 The validity of a radio station ’s license expires and the radio station ’s license becomes invalid immediately. The licensee shall immediately stop using its radio station (station).
Article 10 Radio stations that still need to be used after the expiration of the radio station ’s license must go through the procedures for renewal of the radio station ’s license with the original issuing authority one month before the expiration.
Article 11 For radio stations (stations) that have received radio licenses and have not been used for more than 2 years, the original issuing authority shall withdraw or cancel their radio licenses.
Article 12 When a radio station (station) is deactivated or withdrawn, the station-establishing unit and individual shall take the initiative to return the radio license to the original issuing authority and report on the handling of their equipment.
Article 13 Radio station licenses shall not be transferred to others for use, and imitation or forgery is strictly prohibited.
Article 14: Radio management agencies at all levels shall conduct annual verification of radio station licenses, check the implementation of Articles 7, 8, 9, 10, 11, 12 and payment of frequency occupation fees by licensees, and record the verification And charges.
Article 15 For those who violate these regulations, the Ministry of Information Industry or local radio management agencies will be punished in accordance with the "Regulations of the People's Republic of China on Radio Management" and related regulations.
Article 16 The measures for the management of the licenses of radio stations (stations) for military use shall be separately formulated by the radio management agency of the People's Liberation Army.
Article 17 The Ministry of Information Industry is responsible for interpreting these regulations.
Article 18 These regulations shall be implemented from the date of promulgation.
